1. Copyright Policy
Kounisou Inc. respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and similar international copyright laws.
This policy outlines how to report copyright infringement on our platform and how we respond to such reports.
2. Intellectual Property Ownership
2.1 Coach Content
Coaches retain all intellectual property rights to their original content, including:
- Workout programs and exercise sequences
- Meal plans and nutrition guides
- Educational materials and coaching methodologies
- Photos, videos, and other media they upload
2.2 Platform Content
Kounisou Inc. owns all intellectual property rights to:
- The Kounisou platform software and design
- Our exercise library (including descriptions and images)
- Kounisou branding, logos, and trademarks
- Documentation and help materials
3. Reporting Copyright Infringement
If you believe that content on Kounisou infringes your copyright, please submit a DMCA takedown notice to our Designated Copyright Agent.
3.1 Required Information
Your takedown notice must include:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)
- Identification of the infringing material and information sufficient to locate it on our platform (e.g., URL, username, workout ID)
- Your contact information (name, address, phone number, email)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

4. Our Response to Takedown Notices
Upon receiving a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing content within 48 hours
- Notify the user who posted the content that we have removed it
- Provide the user with a copy of the takedown notice (unless you specifically request otherwise)
- Track repeat infringers and terminate their accounts as appropriate
5. Counter-Notification Procedure
If you believe your content was removed in error or that you have the right to use the material, you may file a DMCA counter-notification.
5.1 Required Information
Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and its previous location
- A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
- Your name, address, phone number, and a statement that you consent to the jurisdiction of the Federal District Court for your district (or your local jurisdiction if outside the US)
- A statement that you will accept service of process from the person who submitted the original takedown notice
5.2 Counter-Notification Process

Upon receiving a valid counter-notification:
- We will forward your counter-notification to the original complainant
- If the complainant does not file a court action within 10-14 business days, we will restore the removed content
- If a court action is filed, we will comply with court orders
6. Repeat Infringer Policy
We maintain a policy of terminating accounts of users who repeatedly infringe copyright. Factors we consider include:
- Number of valid DMCA takedown notices received
- Whether the user has filed counter-notifications (suggesting potential fair use or mistake)
- Severity and nature of the infringement
Typically, accounts with 3 or more valid takedown notices (without successful counter-notifications) will be terminated.

Submitting a false or fraudulent DMCA notice or counter-notification may result in:
- Liability for damages (including costs and attorneys' fees)
- Criminal prosecution for perjury
- Termination of your Kounisou account
Please ensure all claims are made in good faith and are accurate.
8. Fair Use and Exceptions
Not all uses of copyrighted material constitute infringement. Fair use and other exceptions may apply in certain circumstances, such as:
- Commentary, criticism, or parody
- Educational or research purposes
- News reporting
- Transformative use
If you believe your use qualifies as fair use, include that justification in your counter-notification.
9. Trademark Complaints
For trademark infringement claims (e.g., unauthorized use of your business name or logo), please contact us at legal@kounisou.com with:
- Proof of trademark registration or common law rights
- Description of the infringing use
- Location of the infringing content on our platform
10. Content Protection for Coaches
We provide tools to help Coaches protect their content:
- Screenshot detection alerts Coaches when clients take screenshots
- Watermarking options for images and videos (coming soon)
- Terms of service prohibit clients from redistributing Coach content
If you discover unauthorized distribution of your content outside the platform, you may file a DMCA takedown notice directly with the hosting provider or platform where it appears.
